Affiliate Program Terms

Terms for participants in the Haruspex affiliate program.

1. Introduction

These Affiliate Program Terms (“Affiliate Terms”) govern participation in the Haruspex Affiliate Program (“Program”) operated by Haruspex (“Haruspex”, “we”, “our”, or “us”).

By applying for or participating in the Program, you agree to these Affiliate Terms, the Haruspex Terms of Service, Privacy Policy, and any additional policies referenced herein.

Participation in the Program is voluntary.

2. Eligibility

To participate in the Program, you must:

Be at least 18 years old.
Have legal authority to enter into binding agreements.
Provide accurate and complete registration information.
Comply with all applicable laws in your jurisdiction.
Maintain an active Haruspex account in good standing.

Haruspex may approve or reject any affiliate application at its sole discretion.

Approval is not guaranteed.

3. Affiliate Relationship

Affiliates are independent contractors.

Nothing in these Affiliate Terms creates:

employment;
partnership;
joint venture;
agency;
franchise;
fiduciary relationship.

Affiliates have no authority to bind Haruspex or act on its behalf.

4. Affiliate Links

Approved affiliates may receive:

referral links;
referral codes;
tracking identifiers;
marketing assets.

These materials remain the property of Haruspex.

Affiliates may use only officially provided tracking methods.

5. Qualifying Referrals

A qualifying referral is determined solely by Haruspex’s tracking systems.

A referral may qualify only if:

the customer uses the assigned referral link or code;
tracking remains intact;
the referral is not fraudulent;
the account complies with all Haruspex policies.

Haruspex’s records are final in determining referral attribution.

6. Commissions

If commissions are offered, Haruspex may determine:

commission percentages;
payment amounts;
qualifying events;
payment schedules;
minimum payout thresholds;
eligible products or services.

Commission structures may be modified at any time.

No commission is earned until it becomes payable under the Program rules.

7. Current Program Status

Haruspex may operate promotional, beta, or testing phases of the Affiliate Program.

During such periods:

commissions may be unavailable;
payments may be delayed;
rewards may be non-monetary;
referral tracking may be experimental.

Participation during testing does not guarantee future compensation.

8. Marketing Standards

Affiliates must market Haruspex honestly and accurately.

Affiliates must not:

make false statements;
exaggerate platform capabilities;
promise investment returns;
guarantee profits;
provide financial advice while representing Haruspex;
misrepresent pricing;
impersonate Haruspex employees;
create fake testimonials;
use deceptive marketing.

All promotional materials should accurately represent Haruspex’s services.

9. Intellectual Property

Haruspex grants affiliates a limited, revocable, non-exclusive license to use approved:

logos;
trademarks;
banners;
graphics;
marketing materials.

This license ends immediately upon termination from the Program.

Affiliates may not modify Haruspex branding without prior written authorization.

10. Prohibited Activities

Affiliates may not:

purchase referrals;
generate fake accounts;
self-refer unless expressly permitted;
engage in click fraud;
manipulate tracking systems;
use malware;
send unsolicited bulk communications;
engage in keyword hijacking;
impersonate Haruspex;
violate applicable advertising laws.

Haruspex may reverse commissions resulting from prohibited conduct.

11. Paid Advertising

Unless expressly authorized, affiliates may not:

bid on Haruspex trademarks;
impersonate Haruspex in advertisements;
use misleading domain names;
create advertisements suggesting official affiliation.

Haruspex may issue additional advertising guidelines.

12. Email Marketing

Affiliates conducting email marketing must comply with all applicable anti-spam laws.

Affiliates are solely responsible for obtaining required consent from recipients.

Haruspex assumes no responsibility for affiliate marketing practices.

Affiliates promoting Haruspex on social media should clearly disclose affiliate relationships where required by applicable law.

Affiliates remain solely responsible for the content they publish.

14. Taxes

Affiliates are solely responsible for:

taxes;
reporting obligations;
governmental filings;
business registrations.

Haruspex does not provide tax advice.

15. Payment Methods

Where payments are available, Haruspex may determine:

supported payment methods;
payment processors;
payout currencies;
processing schedules.

Haruspex may require identity verification before issuing payments.

16. Fraud Prevention

Haruspex may investigate any referral activity.

We may withhold, delay, adjust, or cancel commissions where we reasonably believe:

fraud occurred;
abuse occurred;
manipulation occurred;
inaccurate tracking occurred;
policy violations occurred.

Investigations may occur before or after payment.

17. Account Suspension

Haruspex may suspend or terminate an affiliate account immediately for:

policy violations;
fraudulent activity;
misleading advertising;
abuse of referral systems;
legal compliance concerns;
conduct harmful to Haruspex.

Termination may result in forfeiture of unpaid commissions arising from prohibited activity.

18. Modification of the Program

Haruspex may modify or discontinue:

commission structures;
referral requirements;
payout schedules;
promotional materials;
Program features;
eligibility requirements.

Changes may take effect immediately unless otherwise stated.

19. No Guaranteed Income

Participation in the Program does not guarantee:

earnings;
commissions;
referrals;
customer conversions;
future payments.

Affiliate performance depends on numerous factors outside Haruspex’s control.

20. Disclaimer

The Affiliate Program is provided on an “as is” and “as available” basis.

Haruspex makes no warranties regarding:

referral volume;
commission amounts;
uninterrupted tracking;
payment frequency;
Program availability.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Haruspex shall not be liable for:

lost commissions;
indirect damages;
consequential damages;
lost business opportunities;
reputational harm;
lost profits.

22. Indemnification

Affiliates agree to indemnify and hold harmless Haruspex, its owners, affiliates, personnel, and service providers from claims arising from:

affiliate marketing activities;
violations of law;
misleading advertising;
infringement of third-party rights;
breaches of these Affiliate Terms.

23. Termination

Either party may terminate participation in the Program at any time.

Upon termination:

affiliate licenses immediately end;
marketing materials must no longer be used;
referral links may be deactivated;
unpaid commissions may be handled according to applicable Program rules.

24. Changes to These Affiliate Terms

Haruspex may revise these Affiliate Terms periodically.

Continued participation after updated terms become effective constitutes acceptance of the revised terms.

25. Governing Law

These Affiliate Terms shall be governed by the laws designated in the Haruspex Terms of Service.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
